False Claims:  How Federal and State Laws Relate to Requests for Payment and/or Equitable Adjustment

This program will outline the federal False Claims Act and provide an overview of the many state statutes that put construction contractors at similar risk of liability for making a misrepresentation. The presenter will also explain how these statutes can complicate cost-plus contracts, change orders and other claims for payment, and the practical steps necessary to avoid crossing the line. The program will conclude with a few words on the potentially severe consequences of a violation, and why it is so important for contractors to get it right.

By attending this webinar, student will be able to:

  • Understand the purpose, scope and penalties for violating the federal False Claims Act (FCA) and similar state laws
  • Identify the different types of “claims” that might be considered “false”
  • Learn how the FCA and similar state laws complicate cost-plus contracts, change orders and other claims for payment
  • Identify the steps necessary to avoid making a “false claim”
  • Learn about FCA enforcement trends, including recent cases and settlements and their potential impact
